Iron Ore Processing (Mineralogy Pty Ltd) Agreement Amendment Act 2008
The company is further advanced in building further projects with its current activities of exploration and exploitation of its remaining iron ore deposits in Pilbara. All mineralogy projects will be developed under the Mineralogy Pty Ltd Act 2002 and the Iron Ore Processing (Mineralogy Pty Ltd) Agreement 2008. Mineralogy has the support of the Government of Western Australia to develop several projects under these laws. For the first time in sixty years, the law unilaterally amended a state agreement. They exempted the State from its defined commitments, removed any rights of appeal and verification, and excluded the principles of natural justice. The company`s activities have focused primarily on the delineation and development of explorations from its portfolio of first-class iron ore, estimated at more than 160 billion tonnes of magnetic resources and located 80 km south of Dampier, in the Pilbara region of Western Australia. . Madeleine McErlain Marketing and Communications Manager (08) 9324 8650 mmcerlain@lawsocietywa.asn.au The Law Society of Western Australia is the state`s highest professional law organisation. The society is a non-profit association dedicated to the representation of its more than 4,000 members.
The company strengthens the legal profession through its position as a respected leader and contributor to law reform, access to justice and the rule of law. The society is widely recognised by the bar, government and the community as the voice of the bar in Western Australia. The new law is unprecedented and extreme. Their provisions, in particular those that restrict public access to information, require further consideration and justification. More fundamentally, the new law touches on a principle on which our legal system is based. Citizens will tolerate being governed by the state on the basis that the state governs according to the rule of law. The rule of law includes a number of concepts, but the most fundamental: all human beings, regardless of their status, are subject to the general law of the country. Deviation from this principle has the ability to influence the foundation of our democracy. The law also excludes the Freedom of Information Act, which normally allows the media and the public to be more transparent in state action and to be able to control information.
It is not clear why this exclusion was necessary or how this exclusion will serve the public interest. Similarly, the public has little opportunity to examine the main grounds of state legislation: the $30 billion potential liability declared. For more than 20 years, mineralogy has been involved in the exploration and exploitation of mineral resources. . The Constitution of our state provides that Parliament is required to pass laws for peace, order and good government in Western Australia. The new law can be analyzed using this standard. The extinction of potentially criant liability is in the interest of the State. This is not damaging the reputation of the state for negligible sovereign risks. Striking a balance between the immediate financial benefits of this law and the long-term effects is a political choice, and it is a difficult choice.
Last week, Parliament passed a law that implements fundamental legal principles. All projects will be world-class, Citic`s $5.8 billion Sino iron ore project (reference), which is currently in production phase, and Australasian Resources $2 billion Balmoral South are located on the company`s Balmoral rental homes, south of the company`s Northern Block.
